Fifth App - Terms of Service

Welcome to Fifth! These Terms of Service ("Terms") govern your use of the Fifth mobile application and related services ("Fifth", "we", "our", or "us"). By using Fifth, you agree to these Terms. If you do not agree, please do not use the app.
By using the App, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the App.
Fifth is a platform for creative expression centered on fashion design. You may use the Service to create, share, and participate in design challenges featuring brand-sponsored and in-house assets.
You agree to use the Service only for lawful purposes and in compliance with these Terms.
To use Fifth, you may be required to create an account. You agree to provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account.
You retain ownership of the designs and creative content you create on Fifth (“Your Content”). By submitting Your Content, you grant Fifth a worldwide, royalty-free, sublicensable, and transferable license to use, display, distribute, reproduce, modify, and publicly perform Your Content within the Service and related marketing and commercial activities.
Brand-owned assets and Fifth-created content remain the property of their respective owners. You may not use these assets outside the Service without permission.
If Fifth enters into a separate agreement with you to produce or monetize your designs (e.g., merchandise, NFTs), the revenue will generally be shared with you on terms agreed upon at that time.
Fifth includes in-app purchases such as virtual currency, season passes, and special challenge access. All purchases are final and non-refundable except where required by law.
Virtual currency and season passes have no monetary value outside the app and cannot be exchanged for real money unless explicitly stated.
You agree that you are solely responsible for Your Content. By submitting Your Content, you represent that you own all rights to it or have the necessary permissions, and that it does not infringe on any third-party rights.
You grant Fifth a license to use Your Content as described in Section 3.1.
You agree not to use the Service to:
Respect the community by refraining from hateful, discriminatory, sexually explicit, or otherwise offensive content or behavior.
When messaging or commenting, communicate respectfully and avoid spam or unsolicited promotions.
Fifth may remove content or suspend accounts that violate these Terms. We reserve discretion to maintain a safe, inclusive environment.
Report inappropriate behavior or content through the app or support channels for timely review.
The Service is intended for users aged 13 and older. Users under the age of majority must have parental or guardian consent.
Parents acknowledge responsibility for their minors’ use of Fifth, including any in-app purchases.
Fifth complies with regional age requirements and privacy laws and will remove accounts found to be in violation.
We may suspend or terminate your account for violations, inactivity, or risks to our community or platform.
You may delete your account via the in-app “Delete Account” feature. Upon deletion, personal data will be handled per our Privacy Policy.
We retain data as necessary to provide services, comply with law, and enforce these Terms.
The Service is provided “as is” without warranties of any kind.
Fifth is not liable for indirect or consequential damages related to your use of the Service.
You agree to indemnify Fifth for claims arising from your violation of these Terms.
These Terms are governed by the laws of Sweden. Disputes shall be resolved in the courts of Stockholm, Sweden.
We may update governing law and jurisdiction to reflect changes in our legal structure, with notice provided via app or website updates. Continued use after changes constitutes acceptance.
